俗話說“人死不能復(fù)生”,但這在本杰明·施萊伯身上似乎不那么準(zhǔn)確了。施萊伯是美國愛荷華州的一名無期徒刑犯人,四年前他曾經(jīng)短暫地“死”過一次。從鬼門關(guān)回來后,他聲稱自己的終身監(jiān)禁在“死”的那一刻就已經(jīng)算服完了,現(xiàn)在應(yīng)該把他放了。
Benjamin Schreiber was sentenced to life in prison without parole in 1997 after being convicted of first-degree murder. In March 2015, he developed large kidney stones that led to septic poisoning, according to court documents.

He eventually fell unconscious in his cell and was taken to a local hospital, where he was resuscitated five separate times, the documents say.

According to the Iowa Court of Appeals, Schreiber "claims he momentarily died at the hospital, thereby fulfilling his 'life' sentence ... Because his sentence has been fulfilled, he argues, he is imprisoned illegally and should be immediately released."

當(dāng)然,法官們可并沒有那么好糊弄。他的兩次上訴都被法官駁回了。
In April 2018, Schreiber filed for post-conviction relief, claiming that he was being held in prison illegally. His sentence was supposed to end with his death, he argued.
2018年4月,施萊伯申請定罪后釋放,聲稱他被非法關(guān)押在監(jiān)獄中。他辯稱,他的刑期本應(yīng)隨著他的死亡而終止。
A district court judge wasn't convinced by his creative attempt to find a loophole in the law, saying that Schreiber's argument was "unpersuasive and without merit". The fact that Schreiber was able to file a legal motion petitioning for his release, the judge added, "in itself confirms the petitioner's current status as living."
但是他這種想鉆法律漏洞的說法,并沒有說服地區(qū)法院的法官。法官說施萊伯的主張“沒有說服力,沒有價值”。事實(shí)上, 施萊伯能夠提出上訴,要求釋放他,“本身就證實(shí)了他目前是活著的狀態(tài)”。
The inmate took his quest to the Iowa Court of Appeals, which was similarly unpersuaded. In an opinion published Wednesday, the panel of judges didn't attempt to reckon with the spiritual or medical definition of "death," a philosophical question that has generated intense legal wrangling and complex debates over medical ethics elsewhere. Instead, they zeroed in on what "life in prison" means.
施萊伯又向愛荷華州法院提起上訴,但同樣沒有說服法官。在周三(11月8日)公布的一份意見書中,評審團(tuán)壓根就沒討論“死亡”的精神定義或是醫(yī)學(xué)定義。相反,他們著重考慮的是“終身監(jiān)禁”的含義。
"Schreiber is either alive, in which case he must remain in prison, or he is dead, in which case this appeal is moot," Potterfield wrote.
“施萊伯要么是個活人,那他就得呆在監(jiān)獄里;要么是個死人,那么這個上訴也就沒意義了。”

施萊伯可能已經(jīng)預(yù)料到一個理由不夠充分,在這第二次上訴中,他還加了一條:醫(yī)生侵犯了他的權(quán)利,沒有遵守他“不要搶救”的要求。
根據(jù)法庭記錄顯示,施萊伯的哥哥只同意給他用藥來緩解他的疼痛,醫(yī)院做出搶救的決定在此之后了。因?yàn)橄录壏ㄔ荷形磳Υ藛栴}做出裁決,評審團(tuán)拒絕回答這個問題。這么一來,施萊伯會不會因“非自愿被救活”真鉆成了這個法律的漏洞,就說不定了。

It’s one hell of a loophole and in all honesty, it’s debatable. I’d suggest someone consider the argument, discuss it and perhaps close the loophole.
